FAQS

Frequently Asked Questions

When should you hire a real estate attorney?

You should consult a real estate attorney as soon as you’re ready to make an offer on a new house. A good real estate attorney can provide valuable legal advice at every turn.

Does New York State require a Real Estate Attorney?

Yes.

What if I live in a state that does not require a real estate attorney?

If you don’t live in a state that requires you to hire a real estate attorney, that doesn’t mean you shouldn’t hire one. In fact, it’s usually recommended that you do, especially if any of the following apply to you:

    • You’re buying a bank-owned property
    • You’re buying a house in another state
    • The home currently has tenants you’ll need to evict
    • The house is part of someone’s estate
    • The home has structural damage
    • The land around the house is subject to floods, hurricanes, tornadoes, and other natural disasters

Five Benefits of Working with a Buyer’s Agent

1. Access to the MLS (Multiple Listing Service)
While many prospective homebuyers enjoy browsing various websites when they are first getting started, the information on these sites are often inaccurate. With homes now selling in a matter of days and multiple offers being submitted, you need to find out immediately when a new home hits the market and meets your criteria. Your buyer’s agent will have access to the MLS and will create a personal account so that you will have all the information at your fingertips.

2. Your Own Personal Home Curator
Think of the buyer’s agent as your very own personal home curator. If there are six homes that you are interested in, it is your buyer agent’s responsibility to plan the best route and schedule each showing with the listing agent. They will either drive you or meet you at each home. Not only is this convenient for you, but this gives your buyer’s agent the opportunity to really get to know your needs and wants in a home.

3. Someone to Walk You Through the Buying Process
It is extremely important to find an agent who will take the time to sit down with you before you begin your home search and outline the entire process from start to finish. Buyers should know how the process works prior to looking at homes. Additionally, a good agent will connect you with the right lenders, attorneys, home inspectors and the necessary parties to get your transaction to closing.

4. They Represent Your Best Interest
When you hire a buyer’s agent, you get the expertise and experience of an agent who is professionally trained in finding you the perfect home. And they will have your best interest in mind when submitting an offer and negotiating the price of the home.

5. They are FREE!
A buyer’s agent is completely FREE to the buyer. Most buyers assume that they will have to pay a fee to use an agent. However, in a residential real estate transaction, the seller pays the commission which is split between the listing and the buyer’s agent.
